Privacy Policy

The following Privacy Policy governs our privacy practices, including on scrubdaddy.com and any affiliate websites, products, services, and platforms, and wherever this Privacy Policy is linked (the “Website”) (however accessed and/or used, whether via personal computers, mobile devices, or otherwise) by Scrub Daddy, Inc. and all of its subsidiaries (collectively, “Scrub Daddy”, “Us”, “We”). This Privacy Policy lets you know how we’re using your personal information and how you can access and update it, when necessary.

This Privacy Policy only covers information collected at the Website, and does not cover any information collected at any other website or offline by Scrub Daddy (unless specifically stated). This Privacy Policy explains the types of information collected about you, including those with whom we interact with in our business-to-business relationships; how your information may be used and when it may be disclosed; how you can control the use and disclosure of your information; and how your information is protected. If you do not agree to our Privacy Policy, please do not use our Website or any of our services.

California Notice at Collection. For our California residents, we collect personal information as described under the “Personal Information Collection” section of this Privacy Policy below. We use the Personal Information collected for our business and commercial purposes as described under the “Use of Personal Information” section below. We do not sell your Personal Information, but we may share Personal Information such as identifiers and internet or other similar network activity with advertising networks. We retain your Personal Information as described under the “Security and Retention” section below.

Personal Information We May Collect

We may collect information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you or, as applicable,  your household, in order to provide you with products and services you request and for those purposes described in this Privacy Policy, (“Personal Information”). We obtain Personal Information from the following categories of sources:

Personal Information you provide us directly and indirectly. Your name, email address, shipping and billing address, phone number, and credit card number may be collected. You could be prompted to create a username and password to access your account. We also may lawfully obtain Personal Information about you from affiliated entities, business partners, and other independent third party sources, such as advertising networks, internet service providers, data analytics providers, operating systems and platforms, social networks, and data brokers, and add it to your account information.  Examples of Personal Information we may receive includes updated contact information, purchase history, and demographic information.

Personal Information automatically collected by us. We may also collect information about your computer/device such as, your IP address, device type, unique device identification numbers, browser type (such as Firefox, Safari, or Internet Explorer), your Internet Service Provider (ISP), a timestamp of your visit and time zone, broad geographic location (e.g., country or city-level location), network status, operating system and carrier, and the last page you visited, in addition to any referring website or exit pages once you leave our site. We may also collect information on your internet connection, information from cookies, web beacons, and other similar technologies and interactions, such as the links clicked on and whether email messages were opened or forwarded. We may combine the Personal Information you give us with information related to your transactions and information we receive about you from third parties who carry out services on our behalf.  The Personal Information received via cookies and web beacons may allow us to track your activities across devices and users’ clickstream data associated with cookies and web beacons.  Please see the “Cookies” and “Web Beacons” sections below for more information.  Collecting this information enables us to better understand the visitors who come to our Website, where they come from, and what content on our Website is of interest to them.  We may also use third party advertising platform pixels, which collect user data for retargeting and remarketing purposes.

If you send Personal Information to Scrub Daddy, the communication you provide (names, email addresses, phone numbers, etc.) is used to facilitate the communication and is not used for other marketing purposes, unless we obtain consent from you.

You may choose not to provide us with your Personal Information. If you choose not to provide us with this Personal Information, you may still access and use portions of the Website. However, you may not be able to use portions of the Website which require you to provide Personal Information, such as the checkout page.

We will limit the collection of Personal Information to what is adequate, relevant, and reasonably necessary in relation to the purposes for which such data is processed without your consent.

Your Location.  To the extent permitted by applicable law, if you’re allowing your location to be tracked on your mobile device, we might take note of your location. You can always disable your location on your phone to prevent this from happening.

Third Party Pixels and Cookies.  Scrub Daddy’s Website uses cookies. Cookies are small data files stored on your computer’s hard drive. This information helps us provide a more personal, customized experience on scrubdaddy.com to help us recognize you as a previous visitor and remember any preferences that may have been set while your browser was visiting our Website. We also use cookies to customize the content and advertisements provided to you on the Website and on other sites across the Internet.  Where permitted by applicable law, when you access a page on our Website, a cookie is automatically set by us, our service providers, or our partners to recognize you as you navigate on the Internet and to present you with information and advertising based on your apparent interests. Cookies also help us measure and research the effectiveness of Website features and offerings, advertisements, and email communications (by determining which emails you open and act upon).  Occasionally, we share Personal Information obtained from cookies with our partners. If you do not want to allow information to be collected through the use of cookies, you can generally opt-out of providing this information by setting your browser to reject cookies. Please note that some areas of the Website may not provide you with an acceptable user experience if you have disabled the use of cookies.

When you visit our Website, log in, register, or open an email, cookies and similar technologies may be used by our online data partners or vendors to associate these activities with information they or others have about you, including your email address. We (or service providers on our behalf) may then send communications and marketing to these email addresses as permitted by applicable law. You may opt out of receiving this advertising by selecting “Deny” when you first visit the Website. You may also opt out by selecting the paper clip on the left side of the Website and selecting “Withdraw your consent”, or unsubscribing from commercial electronic messages where required by applicable law (for more information on unsubscribing, see “Other Important Information” below).  

Web Beacons.  The Website and any communications sent by the Website may contain electronic images (generally, single-pixel “.gif” images) called “web beacons.” These web beacons allow Scrub Daddy and third parties (such as advertising networks, internet service providers, data analytics providers, operating systems and platforms, social networks, and data brokers) to monitor and collect certain information about the viewer of the web page, web-based document, e-mail message, or other communication, such as the type of browser requesting the web beacon, a unique identifier of the device that the web beacon is sent to and the time the web beacon was viewed.  Web beacons may also be used to deliver or read cookies, to understand whether you have come to our site from an online advertisement displayed on a third-party website, to help us understand the performance of our marketing efforts (i.e., interaction with social media advertisements or Website traffic and performance activity), and to improve site performance. We also may allow our service providers to use web beacons to, for example, help us understand which emails have been opened by recipients and to track the visitor traffic and actions on our site. This helps us measure the effectiveness of our content and other offerings.

Embedded Scripts. An embedded script is programming code that is designed to collect information about your interactions with the Website, such as the links you click on. The code is temporarily downloaded onto your device from our server or a third-party service provider, is active only while you are connected to the Website, and it is deactivated or deleted thereafter. In addition, we may use a variety of other technologies that collect similar information for security and fraud detection purposes.

  14. To enforce our Terms of Use and other agreements; and

We may also use your Personal Information for certain business or commercial purposes including:

  1. Auditing related to counting ad impressions to unique visitors and verifying positioning and quality of ad impressions.
  2. Helping to ensure security and integrity.
  3. Debugging to identify and repair errors that impair existing intended functionality.
  4. Short-term, transient use, including for non-personalized advertising.
  5. Performing services on behalf of the business, including maintaining or servicing accounts, providing customer service, processing, or fulfilling orders and transactions, verifying customer information, processing payments, providing financing, providing analytic services, providing storage, or providing similar services on behalf of the business.
  6. Providing advertising and marketing services.
  7. Undertaking internal research for technological development and demonstration.
  8. Undertaking activities to verify or maintain the quality or safety of our services, and to improve, upgrade, or enhance our services.

Please note that information submitted to the Website via a “Contact Us” or other similar mechanism will not necessarily receive a response. We will not use any such Personal Information you provide for marketing purposes unrelated to your request, although we may contact you regarding your submission.

Our Web Site has collected the following personal information from or about its consumers within the last twelve months:

  • Personal information such as name, mailing address, phone number, email address, or other similar identifiers. This information is shared with our service providers and with business partners.
  • California Customer Records Status Categories (CCC § 1798.80 data). Personal information such as name, address, telephone number, credit card number, bank account number, debit card number, or any other financial information. Some information in this category may overlap with other categories. This information is shared with our service providers and with business partners.
  • Commercial Information. Information such as records of products or services purchased, obtained or considered, or other purchasing or consuming histories or tendencies. We disclose this information with service providers and business partners.
  • Internet or other Similar Network Activity. Information such as browsing history, search history, information on a consumer’s interaction with a website, application or advertisement. This information is shared with our service providers and business partners.
  • Geolocation Data. Information such as physical location.
  • Professional or Employment Related Information. Information such as current or past job history or performance evaluations. We do not collect or share this information.
  • Inferences Drawn from Other Personal Information. Information such as profile reflecting a person’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities and aptitudes. We generate this information internally and disclose this data with our service providers and business partners.

The Personal Information we collect may also be used to serve you tailored advertising so that we can provide you with relevant content and information.  We work with third-party service providers to serve and analyze advertisements on the Website and elsewhere online and to provide us with information regarding use of the Website. Analytics providers, ad network providers, ad agencies, advertisers and similar third parties may set and access their own tracking devices (including cookies and web beacons) and they may otherwise collect or have access to information about you and your visits to the Website or other online services. Such information may be used to display targeted ads to you.

We use Google Analytics to enhance how you interact with our Website. Google Analytics provides web analytics services to track, monitor and report website traffic through collection of de-identified data about each visitor to our Website. Information collected may include:

  • IP address and general geolocation information;
  • Demographic data;
  • Browser type;
  • Operating system information;
  • Pages visited;
  • Traffic origin.

Data collected by Google Analytics is stored by Google and shared with us in the form of aggregated reports that allow us to better understand how users interact with our Website.

We may allow third parties to collect information about your online activities through cookies and other technologies over time and across third-party web sites or online services to the extent permitted by applicable law.  These third parties may include (1) business partners, who collect information when you view or interact with one of their advertisements on our Website; and (2) advertising networks, which collect information about your interests when you view or interact with one of the advertisements or tracking mechanisms they place on many different websites.  The information gathered by these parties may be used, for example, to make predictions about your characteristics, interests, or preferences, and to display advertisements on our Website and other unaffiliated web sites tailored to your apparent interests.  Please note that we do not have access to or control over cookies or other technologies these third parties may use to collect information about your interests and the information practices of these third parties is not covered by this Privacy Policy.

Additionally, many third party vendors that engage in behavioral advertising participate in the Network Advertising Initiative (“NAI”) and/or the Digital Advertising Alliance (“DAA”) and abide by NAI and/or DAA principles. If you choose not to receive advertisements tailored to you, you may still see online advertisements, but they will be more general and less relevant to you.

  1. Disclosure of Personal Information

We may have disclosed any of the above categories of Personal Information for our business or commercial purposes within the last twelve months to third parties, including advertising networks, internet service providers, data analytics providers, operating systems and platforms, social networks, government entities, and data brokers. We impose appropriate written contractual obligations on any such service providers for the protection of any Personal Information processed by such service providers on our behalf.

 

Third Party Sharing. We do not sell your personal data to any third party, including the Personal Information of those under 16 years of age.  We may disclose information collected about you as disclosed at the time of collection, as otherwise disclosed in this Privacy Policy, and in the following circumstances:

  1. If Scrub Daddy does a partnership, promotion, contest, or sweepstakes, we may disclose your information with our partner(s). For further details on this, please see “Contests, Promotions, and Sweepstakes,” below.
  2. From time to time, we may have links on our Website that take you outside scrubdaddy.com, to the website of a third party. Once you leave our Website, our Privacy Policy no longer applies. We have no control over such third parties and therefore cannot be responsible for the content, availability, or security of such linked third-party websites. Please read third party privacy policies carefully, as they may use your information for their own purposes. The Website’s link to a third party does not imply endorsement of the linked third-party website or their products and services, and it is provided for your convenience only.

We employ third party service providers to perform functions on our behalf, such as hosting or operating the Website, providing functionality on or helping enhance the security of our Website, sending e-mail and/or other communications, providing wireless services, removing repetitive information from customer lists, data analysis, business analytics, marketing assistance, customer service, credit card processing, distribution of surveys or sweepstakes programs, and fraud prevention. These third parties may have access to your Personal Information for the purpose of performing such functions on the Website’s behalf.  They are not permitted to disclose or use the information for any other purpose.

With Your Consent.  With your consent, we may disclose your Personal Information with third-party marketing partners for their own marketing purposes. We do not disclose your Personal Information with third parties for those third parties’ marketing purposes unless you opt-in to such disclosures. If you do agree to have your Personal Information disclosed, your Personal Information will be disclosed to such third party(s) and all information you disclose will be subject to the privacy policy and practices of such third party(s). We are not responsible for the privacy policies and practices of such third party(s) and, therefore, you should review the privacy policies and practices of such third party(s) prior to agreeing to receive such information from third party(s). If you later decide that you no longer want to receive communication from a third party, you will need to contact that third party directly.

Contests, Promotions and Sweepstakes.  From time to time, we may work with other companies and brands on contests, promotions, or sweepstakes. If you enter one of these types of promotions, your information could be provided to our partner for prize fulfillment and email purposes. Also, when you enter, please carefully review the official rules pertaining to the contest. In some cases, your name and likeness could be used for marketing purposes.

Business Transfers.  We may disclose the information collected through the Website with and among our subsidiaries and affiliates. Scrub Daddy or any of its assets, including the Website, may be sold, or other transactions may occur in which your Personal Information is one of the key business assets for the transaction. Scrub Daddy reserves the right to disclose and transfer user information, including Personal Information, in connection with a corporate merger, consolidation, restructuring, the sale of substantially all of our assets, other corporate change, or in the unlikely event of bankruptcy, and including any due diligence process.

Co-Branded Partners.  Co-Branded Partners are third parties with whom we may jointly offer a service or feature (“Co-Branded Partners”). If you are accessing a service or feature offered by a Co-Branded Partner, the Co-Branded Partner’s name will be featured prominently. You may be asked to provide Personal Information to register for a service offered by a Co-Branded Partner. In doing so, you may be providing your Personal Information to both us and the Co-Branded Partner, or we may disclose your information with the Co-Branded Partner. Please note that the Co-Branded Partner’s privacy policy may also apply to its use of your information.

Law Enforcement or Governing Bodies.  We may disclose your personal data as permitted by law in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, violation of our intellectual property rights, situations involving potential threats to the physical safety of any person, violation of our Terms of Use or other agreements, or as required by law.

We have established, implemented, and maintain various procedures to safeguard your Personal Information, including reasonable technical, administrative, and physical procedures appropriate to the volume and nature of the data at issue.  Although we take reasonable steps to protect your information, no website, Internet transmission, computer system or wireless connection is completely secure.  We also take steps to retain Personal Information about you only for so long as is necessary for the purpose for which it was collected, as required under contract, or as required by or permissible under applicable law.  We will only hold your Personal Information for as long as necessary to fulfill the purposes for which it was collected, before disposing of it in accordance with applicable law. Please note that in many situations we must retain all, or a portion, of your Personal Information to comply with our legal obligations, resolve disputes, enforce our agreements, and to protect against fraudulent, deceptive, or illegal activity, or for another one of our business purposes. Additionally, we will not process data that presents a heightened risk of harm to you without conducting and documenting a data protection assessment of each such processing activity.

Unsubscribe Anytime. You can unsubscribe from marketing emails at any time, but you can’t unsubscribe to emails pertinent to your account, such as billing or shipping notices. You may unsubscribe to marketing emails by following the unsubscribe instructions included in those emails or contacting us at support@scrubdaddy.com.

Correcting or Updating Your Personal Information.  You may change any of your Personal Information in your account by editing your profile within your account or by sending an email to us at support@scrubdaddy.com. You can always ask us to delete your Personal Information, too, by emailing us at support@scrubdaddy.com. We do reserve the right to hold on to Personal Information necessary for doing business with you to the extent permitted by applicable law.

California. If you are a resident of California, you may have additional rights available under the provisions of the California Consumer Privacy Act (“CCPA”) and California’s Shine the Light Law.  See “Privacy Rights” at the end of this Privacy Policy for requests under the CCPA.

Do Not Track and other privacy preference signals.  Some Internet browsers include the ability to transmit “Do Not Track” signals. Since uniform standards for “Do Not Track” signals have not been adopted, this Website does not process or respond to “Do Not Track” signals. We may also respond to other privacy preference signals, such as the Global Privacy Control, in accordance with applicable laws.

Policy for Children. We do not use the Website to solicit information from or market to children under the age of 18. By using the Website, you represent that you are at least 18 years of age. We encourage parents and legal guardians to monitor their children’s internet usage and to instruct their children never to provide Personal Information through the Website or any other website without parental consent. If you believe your child has provided Personal Information to us via the Website, please contact us at support@scrubdaddy.com, and we will use reasonable efforts to locate and delete the information.

Submitting Personal Information From Outside The United States. We control and operate the Website and other online and mobile resources from within the United States (“U.S.”). Personal Information collected through the Website may be transferred, stored, and processed in the U.S. or any other country in which our vendors or we maintain facilities. Although we do not actively block or monitor visitors from other countries, we reserve the right to do so. Your Personal Information may be subject to the local laws of the jurisdiction to which it is transferred, and it may be accessible to local governments, tribunals, law enforcement and regulatory agencies. The Website is directed only at visitors from the U.S. and Canada. As such, this Privacy Policy is consistent with U.S. and Canadian law and practice and is not adapted to other laws (including European data security and privacy laws). Scrub Daddy will only apply the applicable laws of the U.S., and the laws of Canada to residents of Canada only, including as embodied in this Privacy Policy in place of data protections under your home country’s law if you are outside of the U.S. or Canada. For persons outside the U.S. or Canada, by using our Website, you freely and unambiguously acknowledge that this Privacy Policy, not your home country’s laws, controls how we will collect, store, process, and transfer your Personal Information. Similarly, the English language version of this Privacy Policy is the controlling version regardless of any translation you may attempt.

  1. Updates to this Privacy Policy

We may revise this Privacy Policy at any time.  Changes to this Privacy Policy will be made when required in response to changing legal, technical, or business developments. If we update our Privacy Policy, including material updates, we will take appropriate steps to inform you, consistent with the significance of the changes we make, and in accordance with applicable law. You can see when this Privacy Policy was last updated by checking the “last updated” date displayed at the top of this Privacy Policy.  Any changes will go into effect as of the date posted to the Website, and your continued use of the Website constitutes your consent to these changes. Residents in certain states, including California, may be entitled to additional rights with respect to your Personal Information that Scrub Daddy collects and stores about you. Under applicable law, these rights may include:

Right to Access. The right to request that we confirm processing of your Personal Information and disclose certain Personal Information to you about our collection and use of your Personal Information (“Right to Know”). Once we receive and confirm your verifiable consumer request, we will disclose to you, if applicable:

  1. The categories of Personal Information we collected about you.
  2. The categories of sources for the Personal Information we collected about you.
  3. Our business or commercial purpose for collecting that Personal Information.
  4. Our business or commercial purpose for disclosing the category of Personal Information about you.
  5. The specific pieces of Personal Information we collected about you.
  6. A list of third parties to whom we have disclosed your Personal Information.

If we disclosed your Personal Information for a business purpose, we will also disclose:

  1. The categories of Personal Information that we disclosed about you; and
  2. The categories of third parties to whom your Personal Information was disclosed, by category or categories of Personal Information for each third party to whom the Personal Information was disclosed.

Right to Data Portability.  You may have the right to request we provide you with your Personal Information in the form of a [zip file/ftp/other encrypted file] for your use and portability of your data (“Right to Data Portability”).

Right to Deletion.  You may have the right to request that we delete your Personal Information subject to certain exceptions (“Right to Delete”). Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your Personal Information from our records, unless an exception applies.

Right to Correct.  You may have the right to correct your Personal Information

Right to Limit Use and Disclosure of Sensitive Personal Information.  You may have the right to request that we limit our use and disclosure of your sensitive Personal Information. Please note that we do not currently collect your sensitive Personal Information.

Notice of Right to Opt Out.  You have the Right to Opt Out if we are “selling” or “sharing” your information, as those terms are defined by applicable law.  We “share” Personal Information, but only in the context of sharing certain Personal Information collected via Cookies with third party advertising platforms to facilitate targeted digital advertising. You may opt out of our use of Cookies for those purposes through our website’s cookie banner. You may also call us or send an email to enforce your rights to Opt Out of our use of Cookies.

Opt-Out of Certain Uses of Your Personal Information. You may have the right to opt-out of our processing of your Personal Information for: (i) targeted advertising, or (ii) profiling in furtherance of a decision that produces a legal or similarly significant effect.

Appeal. You may have the right to appeal our response to your request. To appeal our response, please email support@scrubdaddy.com and reference your original request.

Exercising Your Privacy Rights.  In order to exercise any of your privacy rights you may contact us by sending an email to: “Your [insert state/province/territory of residence] Privacy Rights” to the email address: support@scrubdaddy.com or you may send a letter by US Mail to:  Scrub Daddy, Inc., Attn: Consumer Services, 1700 Suckle Highway, Pennsauken, New Jersey, 08110.   

In order to verify your request, we will need you to provide at a minimum: your full name and email address.  This information will allow us to verify your identity by confirming that you are the person about whom we collected Personal Information. Please describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. We will not disclose the information you submit with anyone and we will not use it for any other purpose other than verifying your identity.  Once we have verified your identity, we will keep a record of the request only for purposes of complying with our obligations under the applicable law and for no other purpose. 

Authorized Agents.  You may also designate another individual to exercise your rights on your behalf (“Authorized Agent”). If you are an Authorized Agent, we may require you to submit a declaration that you are an Authorized Agent that represents a particular resident prior to responding to your requests.  We may also request that you submit a declaration from the represented resident designating you as an Authorized Agent to make requests on their behalf.

If applicable, the response we provide to you will explain the reasons we cannot fulfill your request.  We do not charge a fee to process or respond to your verifiable consumer request unless it is unfounded, excessive, or repetitive. If we determine that your request warrants a reasonable fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request. We are not required to provide Personal Information to a consumer more than twice in a twelve (12) month period.

Non-Discrimination or Retaliation.  We will not discriminate or retaliate against you because you exercise your rights. For example, Scrub Daddy will not deny you goods or services or deny or limit your access to the Website.
